Official Contest Rules

ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.

1. Eligibility. The MeGotta, Inc. (MEGOTTA) Name that Turtle Contest is open to the General Public at time of entry who have a valid e-mail account. Employees of MEGOTTA, the Sea Turtle Conservancy and Realty Place and each of their respective affiliated companies or agents and the immediate family members of, and any person domiciled with such employees, are not eligible. MEGOTTA is not responsible for Contest line failures or errors in any promotional graphics or advertisements. Winners must be in compliance with all Contest rules.
2. Method of Entry. The Name that Turtle Contest begins on July 23, 2010 at 9:00 AM EDT and all entries must be received via online entry at www.tourdeturtle.org/Naming_Contest by 5:00 PM EDT on July 27, 2010. In MEGOTTA's sole discretion it may announce an extension to the entry deadline not to exceed five (5) days. Each entry must include your name, home phone number, and valid email address along with your entry for a name for a female sea turtle. Name entries will be limited to 30 characters or less. Only one entry per person per day will be accepted with the first entry being the one accepted.
3. Selection of winners. The top three entries will be selected by a panel of judges appointed by MEGOTTA and posted at www.tourdeturtle.org/Naming_Contest on July 29, 2010. A person is only eligible to receive one of the top three entries. The 1st Place winner will be announced on or about July 30, 2010. The decision of the judges in all matters related to the selection of the winners and all matters relating to this Contest are final. Entries will be judged based upon the relevance of the submitted name and its ability to inspire participation in the Tour de Turtles program and be easily remembered by the target audience sea turtle lovers. No names will be accepted that are listed in the Ineligible Names section. Each entry will be time stamped. In the event of duplicate entries, prize winners will be selected based on the order in which the entry was received. Odds of winning depend upon the number and quality of eligible entries received.
4. Prizes. The prize packages are as follows:
a. One (1) 1st Place Prize will be awarded. The 1st Place Prize will include the same prizes as 2nd Place plus 4 VIP passes to attend an evening social with the Sea Turtle Conservancy and attend a turtle walk to locate a nesting turtle at night (planned for July 31, 2010) and to attend the release ceremonies in the morning. If unable to attend your name and the name chosen for the turtle will be announced at the evening social and during the live webcast (planned for August 1, 2010). The total 1st Prize package is valued at $84.
b. One (1) 2nd Place Prize will be awarded. The 2nd Place Prize will include the same prize as 3rd Place and an official 2010 Tour de Turtle t-shirt. The total 2nd Prize package is valued at $44.
c. One (1) 3rd Place Prize will be awarded. The 3rd Place Prize will include two "PlusYou" all access passes to www.turtlesplusyou.com. The total 3rd Prize package is valued at $24.
5. Winner Notification and Acceptance. Winners will be notified via email by July 30, 2010. There shall be no prize substitutions, except as noted herein, and all prizes are non-transferable. Given the uncertainty of nature, if the sea turtle activities of the 1st Place prize are compromised as determined in MEGOTTA's sole discretion, MEGOTTA reserves the right to offer an alternative prize of equal or greater value. Contest winners will be solely responsible for reporting and payment of any taxes, as well as all other costs associated with claiming the prize. Winners, their respective parents or guardians, if under the age of 18, will be required to complete an affidavit of eligibility and a liability and publicity release, as applicable (except where prohibited by law) which must be received by MEGOTTA within five (5) days of the postmark or email date. Failure to sign and return, or confirm by return email, the affidavit and release within five (5) days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of MEGOTTA, result in a winner's disqualification, the forfeiture of his or her interest in the prize and the award of the prize to an alternate winner. The 1st Place winner agrees to participate in a photo/video opportunity with MEGOTTA, at MEGOTTA's election.
6. Participation: Entries that include content that violates the rights of third parties (including, but not limited to, rights of copyright) will be disqualified. Participants grant MEGOTTA and the Sea Turtle Conservancy the right to use their names in advertising and promoting the Contest without further compensation. Submitted names become the property of MEGOTTA and MEGOTTA has the right, but not the obligation to use the names for cause related marketing. The use of personal information collected in the course of the Contest shall be governed by the terms of the MEGOTTA Privacy Statement. By participating, contestants agree to be bound by these Official Rules and the decisions of the judges. MEGOTTA reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by MEGOTTA. In the event the Contest is compromised by tampering or other causes beyond the reasonable control of MEGOTTA which corrupts or impairs the administration, security, fairness or proper operation of the Contest, MEGOTTA reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, MEGOTTA reserves the right to award prizes based on the entries received prior to the termination date. All decisions regarding disqualification of entries shall be the sole discretion of MEGOTTA and the judges. MEGOTTA is not liable for lost, late, delayed, damaged, incomplete, misdirected entries, email or transactions that are lost or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or MEGOTTA. In the event of a dispute, all email entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account.
7. Limitations of Liability. By entering the Contest, entrant agrees that all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees and under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than damages for actual out of pocket expenses.
8. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of any contestant and MEGOTTA, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of laws or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Florida. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provisions were not contained therein.
9. General Release. By entering the Contest, contestants release MEGOTTA, the Sea Turtle Conservancy and their affiliated companies and agents from any liability whatsoever for any claims, costs, injuries, losses or damage of any kind whatsoever arising out of or in connection with the Contest or with the acceptance or possession of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
10. Sponsor. The Name that Turtle Contest is sponsored by MeGotta, Inc., utilizing the www.tourdeturtle.org web site, whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. MEGOTTA will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials related to the Contest. 11. Ineligible Names. The list of names not eligible for this contest were names previously used in the past several years for sea turtles that were being tracked by the Sea Turtle Conservancy and they are:
